You will not believe who made the decision to treat the underwear bomber as a criminal and give him Miranda rights.

In today’s Washington Examiner,Byron York details the interrogation by Republican Senator Jeff Sessions of FBI Director Mueller  before the Judiciary Committee in which we learn that the agents on the ground decided without input from their superiors to treat Umar Farouk Abdul Mutallab as a criminal (who was given a Miranda warning and free counsel) rather than an enemy combatant whom we had free range to question about other potential threats:

Were you contacted about whether or not this individual should be treated as an unlawful enemy combatant or a civilian criminal?”
“No,” said Mueller.

It is shocking to hear from the FBI Director that there is no established protocol to handle these things, especially so soon after the Fort Hood massacre.

Is anybody working in the Department of Justice building or are the lights on with nobody home?
